By proceeding with the making of your travel arrangements through Journiac Travel & Tours, you indicate that you are in agreement with the following terms and conditions.
Journiac Travel & Tours charges a fee for each cancelled reservation, equal to 10% of the pre-tax total (minimum $25), plus tax.
Fees also apply for each change made to a reservation (such as changes to travel dates, destination, etc.). These are calculated at 5% of the pre-tax total or $40 per person, whichever is less (minimum total $25), plus tax.
All fees levied by Journiac Travel & Tours are non-refundable.
Journiac Travel & Tours acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service provider named in your itinerary (“Suppliers”). Journiac Travel & Tours is not responsible for acts or omissions of the Suppliers or their failure to provide services or adhere to their own schedules.
If you have chosen to use a travel supplier (“Supplier”) that we have not recommended or endorsed, then we are not responsible for acts or omissions of the Supplier or its failure to provide services, adhere to its own schedules, or make refunds owed. We do not guarantee or insure such Suppliers. We assume no responsibility for and shall not be liable for any wrongful or negligent acts or omissions on the part of such Suppliers. You hereby release Journiac Travel & Tours from all claims arising out of any problem covered in this paragraph.
If you elect to travel to a destination for which a travel advisory has been issued by the Government of Canada and travel to that destination is not recommended, you hereby acknowledge that you have been made aware of such advisories, and have chosen to travel to the destination in question despite any existing advisories. This includes Global Avoid All Travel Advisories and Avoid All Cruise Travel Advisories issued during the ongoing COVID-19 pandemic. Journiac Travel & Tours is not responsible for any claims whatsoever that may arise from the decision to travel to a country where travel is not recommended.
Journiac Travel & Tours assumes no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; (3) any wrongful or negligent acts or omissions on the part of any other party not under the control of Journiac Travel & Tours; and (4) any Supplier price drop after your travel arrangements have been confirmed, paid in full, or ticketed. You hereby release Journiac Travel & Tours from all claims arising out of any problem covered in this paragraph.
You understand and agree that during the trek, tour, expedition, or other trip in which you will participate, under the arrangements of Journiac Travel & Tours and its agents, employees, associates, affiliated companies, or subcontractors, certain risks and dangers may arise, including, but not limited to, acts of God, the hazards of travelling in unsafe or politically unstable areas or under unsafe conditions, the dangers of civil disturbances and war, forces of nature, the dangers and risks inherent in sporting activities, the negligent or reckless acts or omissions of Journiac Travel & Tours, its agents, employees, officers, directors, associates, affiliated companies, or subcontractors, travel by boat, automobile, train, ship, aircraft, or other means of conveyance, and accident or illness in remote places without access to medical facilities, transportation, or means of rapid evacuation and assistance. Journiac Travel & Tours shall not be responsible for any injuries, damages, or losses caused to any traveller in connection with any of the above and/or terrorist activities, social or labour unrest, mechanical or construction failures or difficulties, diseases, local laws, climatic conditions, abnormal conditions or developments, or any other actions, omissions, or conditions outside the travel agent’s control.
Travel arrangements involving airline, tour, and cruise components are subject to supplemental price increases that may be imposed by the supplier and/or government after you have completed your purchase. You hereby consent to any such price increases and authorize your credit or debit card to be used for them. Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and you may be bound by those contracts regardless of whether you receive notice of their terms. By proceeding with travel arrangements through Journiac Travel & Tours, you are consenting to those terms and conditions.
Journiac Travel & Tours has no special knowledge regarding the financial condition of the Suppliers, unsafe conditions, health hazards, weather hazards, or climate extremes at locations to which you may travel.
You assume full and complete responsibility for checking and verifying any and all passport, visa, vaccination, or other entry requirements of your destination(s), and all conditions regarding health, safety, security, political stability, and labour or civil unrest at such destination(s). You hereby release Journiac Travel & Tours from all claims arising out of any problem covered in this paragraph.
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance. However, no representation or description of the insurance made by our staff constitutes a binding assurance or promise about the insurance. By proceeding with travel arrangements through Journiac Travel & Tours, you waive any liability against Journiac Travel & Tours and its agents, employees, associates, affiliated companies, or subcontractors for any costs you incur as a result of your decision not to purchase travel insurance coverage or your selection of the principal sums and/or sums insured of the insurance(s) that you have purchased. Should you decline to purchase travel insurance coverage due to existing coverage by a credit card policy, employment policy, or other policy, you furthermore waive any liability against Journiac Travel & Tours and its agents, employees, associates, affiliated companies, or subcontractors for any costs you incur as a result of a) restricted benefits, conditions, and/or exclusions related to your existing insurance coverage; b) insufficient protection offered by your existing policy; c) non-existent coverage of your existing travel insurance.
In consideration of, and as a part of the payment for, the right to participate in such treks, tours, expeditions, or other activities and as a part of the payment for, the services arranged for you by Journiac Travel & Tours and its agents, employees, associates, affiliated companies, or subcontractors, you do hereby expressly assume all of the above risks, including, to the extent permitted by law, the risk of negligent or reckless acts or omissions of Journiac Travel & Tours, its agents, employees, officers, directors, associates, affiliated companies, or subcontractors, and you do hereby expressly agree to forever release, discharge, and hold Journiac Travel & Tours and its agents, employees, officers, directors, associates, affiliated companies, and subcontractors harmless against any and all liability, actions, causes of action, debts, suits, claims, and demands of any and every kind and nature whatsoever which you now have or which may hereafter arise out of or in connection with your trip or participation in any activities arranged for you by Journiac Travel & Tours and its agents, employees, associates, affiliated companies, or subcontractors. The terms of this agreement shall serve as a complete release and express assumption of risk for yourself, your heirs, assignees, administrators, executors, and all members of your family, including any minors accompanying you. You hereby agree to all of the conditions of this release. You acknowledge that Journiac Travel & Tours has recommended that you have your attorney review this release. You further agree that any legal dispute involving these travel services shall be heard only by the courts of Ontario, Canada. You acknowledge that in calculating the cost of the tour or trip, Journiac Travel & Tours has relied on your consent to these terms and on their enforceability. In the absence of this Release, the tour/trip cost would have been higher, or, alternatively, Journiac Travel & Tours would be unable to offer these services.
Should a discrepancy arise between the above Terms and Conditions and those provided with a proposal or for a quote, the former will always take precedence.
